Oxygen Not Included EULA Change

Recommended Posts

Hey everybody,

We changed the EULA for Oxygen Not Included on Steam today (the Epic Game Store already had this version). Our previous EULA was very much a document that was written to cover every possible case of every possible thing that might happen and as such included a bunch of language that was unnecessary and didn't apply to the game in any way.

We now have a new EULA that is much more readable and doesn't contain any weird stuff that doesn't even apply to our game.

You can find the new EULA on Steam here: https://store.steampowered.com/eula/457140_eula_0

- Privacy. We respect your privacy and only collect, use and disclose your personal information as described in our Privacy Policy https://www.klei.com/privacy-policy and in this Agreement. Klei may collect metrics regarding your use of the Game, including how long and how often you play the Game. Klei has used reasonable efforts to make this information anonymous (in other words, Klei has tried to exclude information that identifies you personally). You can turn off metrics reporting within the Game if you wish.

- Disclaimer. The Game is “as is”. Klei makes no representations, warranties or guarantees whatsoever about the Game. You install and use the Game completely at your own risk.

- Limitation of Liability. Klei will not be liable to you for any indirect, consequential or special damages whatsoever in connection with the Game. Klei’s only potential liability to you will be for direct damages caused by the Game, and only to a maximum of CDN$100.

Okay who is going to be the one who reads it so the rest of us don't have to?

Why would you allow your friend to run on your Computer in the Background? They could damage it or even destroy it!

There's probably a hamster wheel back there that someone has to run on to keep the computer working.

This is likely not acceptable for EU players.  See the GPRD Art. 4-11:

Quote

‘consent’ of the data subject means any freely given, specific, informed and unambiguous indication of the data subject’s wishes by which he or she, by a statement or by a clear affirmative action, signifies agreement to the processing of personal data relating to him or her;

https://gdpr-info.eu/art-4-gdpr/

iow, the data collection checkbox shall be disabled by default.

You do confirm it by accepting the EULA which you have to do when installing.

The privacy policy contradicts the EULA which shouldn't be considered reliable:

Quote
  • IP address (General geographic location)

  • System specifications (Including mobile device identifiers)

  • Browser information

Klei has used reasonable efforts to make this information anonymous (in other words, Klei has tried to exclude information that identifies you personally)

See Art. 4-1:

Quote

an identifiable natural person is one who can be identified, directly or indirectly, in particular by reference to an identifier such as a name, an identification number, location data, an online identifier
