Pressing on the D-pad to perform ANY Action while you have Embers in your inventory automatically opens the Embers Spell Menu. This means that trying to switch weapons, equip hats, eat food items Etc… all of it opens the Embers Menu. Yes, you are correct I didn't see it announced in any the patch notes, but it's fixed in the live version.
