Issue 1: If chester is one of his special forms and is left on the despawned Pirate Raid boat, digging the x-marks the spot gives you a new chester, not the one that was in the special form.
Have a Shadow Chester and get a pirate raid attack.
Leave Shadow Chester on the pirate boat.
Get the Pirate boat to despawn by going far enough away.
The eyebone got stored into the pirate stash, since the pirate boat is no longer there.
Go dig the pirate stash, the eyebone pops out and notice that chester is in his regular form, not his shadow form.
Issue 2:
If Chester had items in it, the game just straights up disconnects when digging the Pirate Stash.
I tried putting items in a snow chester as my shadow chester did not have any items in it and I got disconnected instead.

A developer has marked this issue as fixed. This means that the issue has been addressed in the current development build and will likely be in the next update.
